Kingcroft Law APC (“Kingcroft,” the “Firm,” “we,” “us,” or “our”) respects your privacy. This Privacy Policy explains how we collect, use, disclose, and protect information in connection with your use of kingcroftlaw.com and any associated pages (the “Site”). By using the Site, you agree to the practices described in this Policy.

1.Scope of This Policy

This Policy covers information collected through the Site. It does not cover information you provide to the Firm as a client or prospective client through other channels, or information governed by the attorney-client privilege, the work-product doctrine, or the Firm’s duty of confidentiality under the California Rules of Professional Conduct and California Business and Professions Code section 6068(e).

The Site is intended for users located in the United States. If you access the Site from outside the United States, you do so on your own initiative and are responsible for compliance with local law.

2.Information We Collect

Information You Provide. When you contact us through the Site—for example, by submitting a contact or inquiry form, requesting a consultation, or subscribing to updates—we collect the information you choose to provide, which may include your name, email address, telephone number, and the contents of your message.

Information Collected Automatically. When you visit the Site, certain information is collected automatically through your device and browser, which may include your internet protocol (IP) address, browser type, device type, operating system, referring pages, pages viewed, and dates and times of access. This information is collected through cookies and similar technologies operated by us and by third-party hosting and analytics providers that support the operation of the Site.

Sensitive Information. Please do not submit sensitive personal information, confidential information, or details about a specific legal matter through the Site. Information you submit through the Site is not treated as confidential or privileged. See Section 7.

3.How We Use Information

We use the information described above to: (a) respond to your inquiries and communicate with you; (b) evaluate and, where appropriate, establish a professional relationship; (c) operate, maintain, secure, and improve the Site; (d) send you updates or communications you have requested; and (e) comply with applicable legal obligations and enforce our Terms of Use.

4.Cookies, Analytics, and Do-Not-Track

The Site uses cookies and similar technologies, including those provided by third-party hosting and analytics providers, to operate the Site and understand how it is used. You can set your browser to refuse cookies or to alert you when cookies are being sent; however, some portions of the Site may not function properly without them.

Do-Not-Track and Global Privacy Control. Some browsers transmit “Do-Not-Track” or Global Privacy Control (GPC) signals. Because there is no common industry standard for responding to Do-Not-Track signals, the Site does not currently respond differently to them. We do not sell or share your personal information, as described in Section 5.

5.How We Disclose Information

Service Providers. We disclose information to third-party service providers that perform functions on our behalf—such as website hosting, infrastructure, and analytics—and that are permitted to use the information only to provide those services to us.

Legal and Protective Disclosures. We may disclose information where required by law, subpoena, or legal process, or where we believe in good faith that disclosure is necessary to protect our rights, your safety or the safety of others, or to investigate fraud or respond to a governmental request.

Business Transfers. If the Firm is involved in a merger, reorganization, or transfer of all or part of its assets, information may be transferred as part of that transaction, subject to this Policy.

No Sale or Sharing. We do not sell your personal information, and we do not share your personal information for cross-context behavioral advertising or for monetary or other valuable consideration.

6.Data Retention

We retain information collected through the Site for as long as necessary to fulfill the purposes described in this Policy, to comply with our legal, regulatory, and professional-responsibility obligations, to resolve disputes, and to enforce our agreements. Retention periods vary depending on the nature of the information and the purpose for which it was collected.

7.No Attorney-Client Relationship; No Confidentiality Through the Site

Using the Site, submitting information through the Site, or communicating with the Firm through the Site does not create an attorney-client relationship. An attorney-client relationship with the Firm is established only through a signed written engagement agreement.

Information you transmit through the Site is not privileged or confidential and may not be protected by the attorney-client privilege or the work-product doctrine. Do not send confidential or time-sensitive information through the Site, and do not include information about a specific legal matter, until an attorney-client relationship has been established in writing.

8.Our Use of Technology and Artificial Intelligence

The Firm uses vetted third-party technology, which may include artificial-intelligence tools, to support its operations and the delivery of legal services. Where the Firm uses such tools in connection with client work, it does so under agreements that prohibit the use of client data to train third-party models and that impose confidentiality and data-handling obligations consistent with the Firm’s professional responsibilities, and all such work remains subject to review by a licensed attorney. Any interactive feature made available on the Site is provided for general informational purposes only, and you should not submit confidential information through any such feature.

9.Data Security

We maintain reasonable administrative, technical, and physical safeguards designed to protect information collected through the Site. However, no method of transmission over the internet or method of electronic storage is completely secure, and we cannot guarantee absolute security.

10.Your Privacy Choices and Rights

You may decline to provide information through the Site, though this may limit your ability to use certain features. You may unsubscribe from Firm communications at any time using the mechanism provided in those communications or by contacting us.

California Residents. Although the Firm is not currently a “business” subject to the California Consumer Privacy Act, as amended, we voluntarily honor requests from California residents to know, access, correct, or delete personal information we have collected through the Site, subject to applicable exceptions, including our professional-responsibility and recordkeeping obligations. To make a request, contact us using the information in Section 14. We will not discriminate against you for exercising these choices.

Shine the Light. California Civil Code section 1798.83 permits California residents to request information regarding disclosure of personal information to third parties for their direct marketing purposes. We do not disclose personal information to third parties for their direct marketing purposes.

11.Third-Party Links

The Site may contain links to third-party websites and resources. We are not responsible for the privacy practices or content of those third parties, and this Policy does not apply to them. We encourage you to review the privacy policies of any third-party sites you visit.

12.Children’s Privacy

The Site is not directed to children under the age of 13, and we do not knowingly collect personal information from children under 13. If you believe a child has provided us with personal information, please contact us and we will take appropriate steps to delete it.

13.Changes to This Policy

We may update this Policy from time to time. The “Effective Date” at the top indicates when this Policy was last revised. Material changes will be reflected by updating that date and posting the revised Policy on the Site. Your continued use of the Site after changes are posted constitutes your acceptance of the revised Policy.
